Terms of service
Version of October 20, 2026. These terms apply to every website creation and hosting service provided by Votre Vitrine. They complement the accepted quote, which prevails in case of difference.
1. The provider
Tom Chamart, sole proprietor (French micro-entreprise)
Registered office: 84440 Robion, France · French business registration (SIRET): 882 794 753 00039
Phone: +33 6 26 02 31 08 · Email: [email protected]
VAT not applicable, article 293 B of the French General Tax Code.
The services are intended for businesses: shops, restaurants, trades, independent professionals and associations.
2. The service
The Storefront plan includes a one-page website designed to be read on a phone: cover photo, presentation, menu or services with their prices, reviews, hours with the live open-or-closed status, address with map and directions, buttons to call, write and book, a contact form with a privacy notice, and a legal page. It also includes the domain name, hosting, the security certificate (HTTPS) and the updates described in article 7.
The Custom plan takes the Storefront plan and adds what the client needs: a second language, extra pages, copywriting. It is the subject of a specific quote.
The site is built with standard web technology (HTML, CSS, JavaScript) and depends on no proprietary platform: any other provider can take it over.
3. Order
The order is formed when the quote is accepted, by signature or by a confirmation email saying “agreed”. The quote is free and valid for thirty days.
4. Prices
Storefront plan: $299 to build the site, then $25 a month, invoiced $75 per quarter in advance. Custom plan: from $490 to build, subscription as quoted. Prices are in US dollars. No VAT is charged: the service is provided from France by a VAT-exempt business. Any tax that may apply where you are is your responsibility.
The subscription price may be revised once a year, with two months' notice by email. A client who refuses the revision may terminate free of charge before it takes effect.
5. Payment
No deposit is required. The creation and the first quarter of subscription are invoiced when the site goes live; the following quarters are invoiced at the start of each quarter. Invoices are payable within thirty days, by card or bank transfer as indicated on the invoice.
After a written reminder left without effect, late payments bear interest at three times the French statutory rate and a fixed recovery fee of €40, as French law provides (articles L. 441-10 and D. 441-5 of the French Commercial Code). Fifteen days after the reminder, the provider may suspend the site, then terminate the contract.
6. Delivery time
The site goes live within one week of the day the provider has received everything needed: hours, contact details, texts, photos, menu or list of services with prices. The time is paused while an element is missing, and during the client's review.
7. Updates included in the subscription
The client sends requests by WhatsApp, text message or email. They go live within 48 hours, on business days. Changes to existing content are included:
- hours, closing days, seasonal closure and its dates;
- contact details: phone, email, address, links to social networks or online booking;
- prices, menu, list of services;
- correction or replacement of an existing text;
- replacement of a photo by another, supplied ready to publish.
These updates are included within a limit of two requests a month. The limit is a safeguard, not a quota to watch: beyond it, the provider does not refuse, it sends a quote.
Not included, and subject to a quote:
- adding a new page or section;
- a redesign, a change of business name or logo;
- copywriting, retouching, cropping or resizing photos;
- translation into another language;
- online sales, built-in appointment booking, connection to an outside tool.
8. What the client provides
The client provides the information and documents needed and is responsible for their accuracy, in particular prices, hours and the notices its trade requires. It warrants that it holds the rights to the texts, photos, logos and trademarks it sends, and holds the provider harmless against any third-party claim about them. The provider may refuse to publish clearly unlawful content.
9. Domain name, hosting, search engines
The domain name is registered in the client's name, who owns it. Its cost is included in the subscription for as long as the subscription lasts.
The site is hosted on a server located in France, behind the network of Cloudflare, Inc. It is backed up every night, and backups are kept for thirty days. The provider undertakes to use the means needed to keep the site available, without guaranteeing a figure; maintenance interruptions are announced in advance when possible.
The provider applies the technical means of good local search ranking: speed, readability on a phone, content structure, information passed to search engines, help with the business's Google Business Profile. No position in search results can be guaranteed: it depends on Google alone.
10. Term and termination
The subscription has no minimum term. The client may terminate at any time by email with one month's notice; termination takes effect at the end of the current quarter, already invoiced, and no new quarter is invoiced. The provider may terminate in the same way with two months' notice.
At the end of the contract, whatever the reason, the client receives on request the files of the site (code and content) and keeps its domain name, transferred free of charge if requested within thirty days. After that, the provider no longer hosts the site nor renews the domain.
11. Reference
Unless the client refuses in writing, the provider may mention its name and show an image of its site among its work, on its own site and in its sales documents. The client may withdraw this permission at any time by email.
12. Cooling-off period
Whatever the law of your state provides, every client has fourteen days from the conclusion of the contract to cancel it, for any reason and at no cost, by writing to [email protected]. Any amount paid is refunded within fourteen days.
A client who wants the site online without waiting asks for it expressly in writing; the right to cancel then ends once the site has been delivered. Otherwise, work starts after the fourteen days.
13. Personal data
For the information about the client itself, the provider is responsible for the data: it is used to perform the contract and meet accounting obligations. Privacy policy.
For the messages received through the contact form of the client's site, the client is responsible for the data and the provider acts as its processor. As such, the provider processes this data only to deliver the messages to the client and keep the site running, keeps it confidential, hosts it in France, uses a single sub-processor for email notifications (Resend, USA), deletes the messages automatically at the end of the retention period stated in the site's legal page, assists the client when a visitor asks to exercise their rights, and returns or deletes the data at the end of the contract, as the client chooses.
14. Liability
The provider is bound by an obligation of means. It is not liable for content supplied by the client, for an interruption caused by a third party (host, registrar, carrier, Cloudflare) or by force majeure, nor for loss of profit. In any event, its liability is limited to the amounts paid by the client in the twelve months before the event giving rise to it.
15. Claims, governing law
Any claim may be sent to [email protected] or by phone at +33 6 26 02 31 08; the provider undertakes to answer within eight days. The contract is governed by French law. Failing an amicable settlement, disputes are brought before the courts of the provider's registered office, without prejudice to any mandatory protection the law of the client's place of business grants it.
